    1. Approval of the Agreement
    In order to become a member of STAYGENIUSLIVING.COM, you must first fill out our registration form and accept and undertake to comply with the provisions of the STAYGENIUSLIVING.COM membership agreement.
    By selecting the option “I accept the terms of use of the site,” you shall be deemed to have accepted the conditions written below.
    From the moment the User completes and approves the registration form, or receives any service through this system, or MAKES A RESERVATION, the User shall be deemed to have undertaken to comply with the STAYGENIUSLIVING.COM agreement.

    2. Description of Services
    STAYGENIUSLIVING.COM provides its members who approve this agreement with the opportunity to make hotel room reservations via the internet.

    3. STAYGENIUSLIVING.COM Membership System
    • Each STAYGENIUSLIVING.COM member has a “username” and “password” determined by themselves.
    • The “username” is unique to the member and cannot be assigned to two different members.
    • The “password” is known only by the user. The user may change their password at any time. The selection and protection of the password are entirely the responsibility of the user. STAYGENIUSLIVING.COM shall not be responsible for any issues arising from password usage.
    • STAYGENIUSLIVING.COM may inform the user about available promotions via email. STAYGENIUSLIVING.COM does not share user information with third-party companies – however, phone number and email address may be shared with the accommodation facility for faster and more accurate delivery of reservation requests. It does not send emails on behalf of third-party companies.
    • In order to access services requiring membership, the user must enter their username and password. This process is defined as “logging in” to STAYGENIUSLIVING.COM.

    4. Obligations of the Member
    • While benefiting from the services of STAYGENIUSLIVING.COM, the member:
    • Accepts that the information provided in the registration form is accurate and that they are responsible for any disruptions or damages arising from incorrect or incomplete information (including forgotten passwords), and that their membership may be terminated in such cases,
    • Accepts that the copyrights of the services, software, and content provided by STAYGENIUSLIVING.COM belong to STAYGENIUSLIVING.COM and undertakes not to copy or distribute them in any way,
    • Accepts that all personal opinions, expressions, files uploaded, requests sent, and personal information shared while using STAYGENIUSLIVING.COM services are their own responsibility and that STAYGENIUSLIVING.COM cannot be held liable for them,
    • Accepts that services may include content intended for individuals over 18 years of age and that STAYGENIUSLIVING.COM is not responsible for such content,
    • Accepts that STAYGENIUSLIVING.COM is not responsible for any information, messages, or files lost, incomplete, or sent to incorrect addresses during use of the site,
    • Undertakes not to access services outside authorized methods or modify the software in any way, and agrees to compensate all material and moral damages that may arise from violations,
    • Accepts that STAYGENIUSLIVING.COM is not responsible for damages arising from unauthorized access to user data,
    • Undertakes not to send threatening, immoral, racist, or unlawful messages in violation of Turkish laws or international agreements,
    • Undertakes that all shared content complies with general morality, etiquette, and legal rules,
    • Undertakes not to harass or threaten other users,
    • Undertakes not to behave in a way that affects other users’ use of the site,
    • Undertakes not to publish unlawful, defamatory, immoral, or inappropriate content,
    • Undertakes not to advertise, sell, or promote goods/services, or engage in surveys, competitions, or chain messages,
    • Undertakes not to send harmful software or data to other users,
    • Accepts that all materials obtained through services are used at their own risk and that all damages belong solely to them,
    • Undertakes not to use services for commercial or advertising purposes without permission,
    • Accepts that STAYGENIUSLIVING.COM may monitor the system at any time,
    • Accepts that STAYGENIUSLIVING.COM may intervene, suspend, or terminate membership in case of rule violations,
    • Accepts that STAYGENIUSLIVING.COM may use the system for commercial purposes,
    • Undertakes not to send prohibited content or unauthorized messages (such as chain mails or viruses),
    • Undertakes not to record or misuse personal data of others,
    • Accepts full responsibility for all actions performed under their username,
    • Accepts that payment must be made directly to the accommodation facility under its stated conditions, otherwise service may be denied,
    • Accepts that cancellation must comply with the facility’s cancellation conditions, otherwise fees may be charged,
    • Accepts that if a reservation is used by another person, required documentation must be signed, otherwise access may be denied and fees charged.

    5. Authorities Granted to STAYGENIUSLIVING.COM by Users
    • STAYGENIUSLIVING.COM may temporarily suspend or permanently stop the system at any time.
    • It shall have no liability to members or third parties for such suspension or termination.
    • It may restrict access or require password changes at its discretion.
    • It undertakes to transmit reservations properly but does not guarantee service quality or outcomes.
    • It may back up or delete user data at its discretion and is not responsible for such actions.
    • It holds all intellectual property rights for its content and materials.
    • Availability of accommodations is limited and not guaranteed.
    • It may publish, move, or reuse user-generated content without compensation.
    • Changes in accommodation details are the responsibility of the facility.
    • It may redirect users to external websites without responsibility.
    • It may amend this agreement or introduce new provisions.
    • It may convert free services into paid services or modify offerings.

    6. Limitation of Personal and Non-Commercial Use
    Individual users accept that purchases are for personal use only. Corporate users may use the system commercially, but commission is not paid unless agreed in writing. Commercial users must hold a travel agency license. No usage fee is charged to customers making reservations.

    7. Fees, Payment, Invoice, Commission and Taxation
    Legal changes are outside STAYGENIUSLIVING.COM’s responsibility. Payments are made directly to the accommodation facility. No commercial relationship exists between the user and STAYGENIUSLIVING.COM. Invoices are issued by the accommodation facility.

    8. Use of Reserved Room
    If the customer does not use the reservation, the facility’s cancellation policy applies. The customer accepts all legal obligations.

    9. Reservation Cancellation
    Cancellation conditions vary per facility and are accepted during booking.
    Refunds may be made directly by the accommodation facility under specific conditions such as:
    • Reservation not received or not accepted
    • Lack of availability
    • Proper cancellation
    • Service impossibility
    • System transmission failure
    • Mismatch between advertised and actual service

    STAYGENIUSLIVING.COM is not a party to refund disputes.

    10. Validity of Records
    In disputes, STAYGENIUSLIVING.COM records shall constitute binding and definitive evidence.

    11. Applicable Law
    Turkish law shall apply.

    12. Jurisdiction and Enforcement
    Istanbul Çağlayan Courts and Enforcement Offices shall have jurisdiction.
    This agreement enters into force upon acceptance and use of the system without any time limitation.

    Definitions: “staygeniusliving.com”, “we”, “us”, or “our” refer to GENIUS TURİZM SAĞLIK SERVİS DANIŞMANLIK İÇ VE DIŞ TİCARET LTD.ŞTİ, a company incorporated under the laws of the Republic of Türkiye, with its registered address at Halil Rıfat Paşa Mah. The content published on these web pages (such as software, products, logos, trademarks, information, reports, images, and graphics) is protected by national and international laws and international agreements.

    The User agrees and undertakes not to reproduce, copy, distribute, process, transmit online or by any other means, in whole or in part, any products, information, databases, images, texts, icons, visual or audio materials, video clips, files, website elements, software codes, HTML codes, other codes, designs, catalogs, and lists available on the website, nor to engage in direct or indirect competition with Genius Living through such actions or by any other means.

    Any information or material on the site:
    • May not be used in a different form by revising, adding to, or modifying the whole or any part of the site.

The current and updated version is available on these pages. By using these web pages, the user agrees to be bound by the current version.
